IN THIS ESSAY I PROPOSE SEVERAL SWEEPING PROPOSITIONS ABOUT INternational order: that it is structurally prior to international peace and justice and required for it; that in the anarchical society of international politics any order must be based on the principle of voluntary association and exclusion, with their attached rewards and sanctions; that such a working order has been emerging over centuries and has resulted in an undeniable growth of world peace, though without ending war; and that this emergent international (...) order is now under attack from various directions. One such attack—not the worst or most dangerous in the long run but very grave at present—is the current foreign policy of the United States, which directly denies or indirectly subverts the principles and trends that have led to the emergence of a promising international order. The notion of 'the first person' is centrally invoked in philosophical discussions of selfhood, subjectivity, and personhood. We ask whether this notion, as invoked in these discussions, is con-tingently or essentially a grammatical term. While it is logically possible that the linguistic dimensions of self-reference are accidental to this phenomenon, we argue that no explications of such phenomena as 'reference de se' or 'essential indexicality' in non-grammatical terms has been or likely can be provided, since grammatical factors uniquely co-vary with (...) the forms of self-reference in question. The role of grammar is reinforced by the fact that species-specific forms of reference are never purely lexical and always have a structural signature involving specific grammatical configurations; and by findings that in cognitive disorders independently characterized as disorders of selfhood, such as autism spectrum conditions, the pronominal system proves to be a particular locus of vulnerability. We conclude that grammar and human-specific forms of selfhood form an inextricable unity, inviting renewed attention to language as a constitutive condition of personhood in at least some of its forms. Course Correction engages in deliberation about what the twenty-first-century university needs to do in order to re-find its focus as a protected place for unfettered commitment to knowledge, not just as a space for creating employment or economic prosperity. The university's business, Paul W. Gooch writes, is to generate and critique knowledge claims, and to transmit and certify the acquisition of knowledge. In order to achieve this, a university must have a reputation for integrity and trustworthiness, and this, in (...) turn, requires a diligent and respectful level of autonomy from state, religion, and other powerful influences. It also requires embracing the challenges of academic freedom and the effective governance of an academic community. Course Correction raises three important questions about the twenty-first-century university. In discussing the dominant attention to student experience, the book asks, "Is it now all about students?" Secondly, in questioning "What knowledge should undergraduates gain?" it provides a critique of undergraduate experience, advocating a Socratic approach to education as interrogative conversation. Finally, by asking "What and where are well-placed universities?" the book makes the case against placeless education offered in the digital world, in favour of education that takes account of its place in time and space. Arguing from these insights, Kahn offers a new reading of the liberalism/communitarian debate, a genealogy of American liberalism, an exploration of the romantic and the pornographic, a new theory of the will, and a refoundation of political theory on the possibility of sacrifice.Approaching politics from the perspective of sacrifice allows us to understand the character of twentieth-century politics, which combined progress in the rule of law with massive slaughter for the state. Equally important, this work speaks to the most important political conflicts in the world today. It explains why American response to September 11 has taken the form of war, and why, for the most part, Europeans have been reluctant to follow the Americans in their pursuit of a violent, sacrificial politics. In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each that (...) is responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. Turning to law, Kahn demonstrates how the line between exception and judicial decision is not as sharp as Schmitt led us to believe. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Aristotle argued that citizenship is like friendship, and this book applies his argument to modern society. Modern citizens may lack the concept of civic friendship, but they persist in many practices and passions that were once considered essential to it. Citizens share many similarities with friends: prejudices held in common, favoritism towards each other, and - despite disagreement on specifics - underlying agreement about what is important, such as freedom and equality. Aristotle's theory reminds us that civic friendship is a (...) factual condition of healthy societies, not a pie-in-the-sky ideal. By recognizing when it occurs and understanding it, we can build on it to counteract societal polarization. Civic friendship offers an alternative to populism and nationalism by engaging some of the same passions. In an era increasingly marked by tribalism and identity politics, this timely study will be of interest to a wide range of readers in political science, classics, and philosophy. (shrink)

In a project, order is produced by the intentional act of a subject; in a system, order is immanent in the world. In the former, order is made; in the latter, discovered. Paul W. Against this background, Kahn explains the development of the modern legal imagination in the nineteenth century as a movement from project to system. Americans began the century imagining the constitutional order as their common project: a deliberate construction of We the People. They ended the century imagining that order is continuous with the common law: an immanent development of the principles of civilization. In Out of Eden, Paul W. Kahn offers a philosophical meditation on the problem of evil. He uses the Genesis story of the Fall as the starting point for a profound articulation of the human condition.

Current clinical guidelines for the treatment of individuals who experience gender dysphoria include the administration of testosterone to women who desire to appear as men and estrogen to men who desire to appear as women. Despite the rapid and widespread adoption of this practice, strikingly little scientific evidence supports this treatment approach as a safe and effective medical intervention to prevent associated depression and suicide. Although low-quality, short-term studies have demonstrated a reduction of dysphoria, emerging evidence reveals significant bodily harm (...) from this practice and a lack of long-term benefit in preventing depression and suicide. From an ethical perspective, this practice distorts a proper view of human nature and violates bodily integrity by directly inducing sterility. The use of exogenous cross-sex hormones reinforces rather than alleviates underlying psychiatric dysfunction while significantly increasing the risk of other medical morbidities. Despite the valid goal of alleviating suffering, this practice cannot be justified by the use of the principles of totality or double effect. (shrink)

I present the foundational structure for a life-centered theory of environmental ethics. The structure consists of three interrelated components. First is the adopting of a certain ultimate moral attitude toward nature, which I call “respect for nature.” Second is a belief system that constitutes a way of conceiving of the natural world and of our place in it. This belief system underlies and supports the attitude in a way that makes it an appropriate attitude to take toward the Earth’s natural (...) ecosystems and their life communities. Third is a system of moral rules and standards for guiding our treatment of those ecosystems and life communities, a set of normative principles which give concrete embodiment or expression to the attitude of respect for nature. The theory set forth and defended here is, I hold, structurally symmetrical with a theory of human ethics based on the principle of respect for persons. (shrink)

An analogy is drawn between the processes of human language evolution and the ongoing discoveries concerning how the human genome is constructed. Mutational evolution may be thought of in linguistic terms as an alternation in the genetic code following morphemic substitutions, deletions or additions. This may be termed an endosemiotic analysis where semiotic processes may be found at the biochemical level of the genome. Hence, owing to these genetic changes, phenotypic alterations in the morphology of the organism create those evolutionary (...) changes seen in the development of the phyla in the paleontological record. We are now witnessing the inclusion of the genome of all species both plant and animal within our material culture as we begin to modify these genotypes with recombinant DNA/rna technology. The coevolution of language and the genetic code may then occur as we begin to more thoroughly understand these interrelated evolutionary processes. (shrink)

That utility is not a sufficient test for a set of social rules to be morally binding upon a group of persons has been argued in a number of recent books and articles. Yet it is generally conceded in these arguments that a group's observance of rules makes possible greater benefits than would accrue if each did not associate himself with others under the rules. It is not denied that the practice of morality is socially advantageous. What is denied is (...) that social advantage is either the sole criterion or a sufficient criterion for the justifiability of any set of rules that could constitute the de facto system of moral requirements in a given society.What, then, is sufficient? The answer I am interested in defending in this paper is that both utility as an aggregative principle and justice as a distributive principle are each a necessary condition and together provide a sufficient condition for the justification of a moral code. In the first two parts of this paper, I shall explain how the concepts of justice and utility, respectively, are to be construed in the argument of the third part. (shrink)

Paul and Religion demonstrates the continuing and contemporary relevance of the most important, and most controversial, figure of early Christianity. Paul Gooch interrogates the Pauline writings for their meaning as well as implications for religion as an entire form of life, a stance on the world expressed in distinctive practices. Bringing a philosophical approach to this topic, he connects Paul's ideas to lived experience. In a conversational style, Gooch explores Paul's experience of grace and his dismissal (...) of distinctive markers of religious identity in favour of love as binding together a community. Contrary to common expectations, he finds within Paul's letters material for conversations about issues in our day, such as gender and sexuality. From his close reading of the Letters, Gooch argues that the Pauline religious form of life is not identical with institutional Christianity.
